1. Who we are

In these Terms, "we", "us" and "our" mean Kashmir Online Store, and "you" means the person browsing the site or placing an order. Our store is hosted on Shopify Inc., which provides the e-commerce platform. Full statutory details are on our Legal Notice page.

2. Eligibility and use of the website

You must be at least 18 years old, or using the site under the supervision of a parent or guardian, to place an order.

You may use this website to browse our range and order for your own use. You agree not to use it in any way that damages the site, disrupts other users' access, breaches Indian law, or involves scraping, data harvesting or automated bulk extraction of our content. You must not upload malicious code, attempt to circumvent security features, impersonate another person, or submit false information.

If you create an account you are responsible for keeping your password confidential and for activity under your account. Tell us promptly if you believe it has been used without your permission. We may suspend or terminate access where these Terms are breached.

3. Products and descriptions

We sell food and wellness products — saffron, shilajit, honey, dry fruits, kahwa, spices, cold-pressed oils, preserves and natural skincare — alongside embroidered apparel and handicraft.

Natural variation

Our foods are agricultural goods. Colour, size, texture and aroma vary from batch to batch and from the photographs on the site. Product images are indicative, and packaging design may change without notice.

Craft variation

Where a piece is hand-worked, hand-woven or naturally dyed, no two are identical. Small differences in shade, stitch density, motif placement, weave texture and finished measurements are inherent to the craft rather than defects. Screen calibration also affects how colours appear. Garment measurements are stated on each product page; please read them before ordering.

Origin and embroidery

Where a product is described as Kashmiri, it is sourced or made in the valley. Items that do not originate in Kashmir are sold under their true origin on the product page. Most of our apparel carries machine embroidery in traditional Kashmiri patterns, and the product page states this. Genuinely hand-worked pieces are identified as such.

5. Prices, taxes and payment

All prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise on the product page. GST invoices are issued as required; share your GSTIN at checkout if you need it on the invoice.

We may change prices, run offers or withdraw discounts at any time, but a change will not affect an order we have already accepted. Where a product is listed at an obviously incorrect price due to a technical or typographical error, we may cancel the order and refund you in full rather than supply at that price.

We accept UPI, credit and debit cards, net banking, wallets, and Cash on Delivery across India. Online payments are processed by third-party gateways; we do not see or store your card number, CVV or UPI PIN. Discount codes are single-use per customer unless stated otherwise, cannot be combined, and may be withdrawn where misused.

6. Orders and acceptance

Placing an order is an offer to buy. Our order confirmation email acknowledges receipt of that offer; the contract between us is formed when we dispatch the order.

We may decline or cancel an order, in whole or in part, where the item is out of stock, where there is a pricing or listing error, where we cannot deliver to your pin code, or where we reasonably suspect fraudulent, abusive or reseller activity. If we cancel an order you have paid for, we refund it in full.

Because each handcrafted piece is unique, apparel stock can sell out between your order and dispatch. If that happens we will offer you a comparable piece, a later delivery date, or a full refund — your choice. We may limit quantities per person, household or order.

7. Made-to-measure and customised orders

Where a garment is stitched to your measurements or customised at your request, production begins once you confirm your measurements and specifications. Such orders may be cancelled within 24 hours of that confirmation; after that they cannot be cancelled, returned or exchanged, as the piece cannot be resold.

You are responsible for the accuracy of the measurements you provide. If the finished garment does not match the measurements you gave us, we correct or remake it at our cost.

8. Delivery

Shipping within India is free on every order. Orders are dispatched within 3 working days and usually delivered within 7 to 8 working days, varying by location. Timelines are estimates, not guarantees, and may be affected by courier delays, weather, highway closures, connectivity disruptions or other events outside our control.

Risk in the goods passes to you on delivery. Please check the packaging at the door — if it is tampered with or damaged, refuse the parcel and inform us the same day.

9. Returns, refunds and cancellations

Sealed food, wellness, skincare and preserve items may be returned within 30 days of delivery; opened consumables cannot be taken back for health and safety reasons. Apparel may be returned within 15 days if unworn, unwashed and with all tags attached, and we offer one free size exchange. Damaged, wrong or missing items must be reported within 48 hours of delivery. Our Returns, Refunds & Cancellations policy forms part of these Terms.

10. Intellectual property

The content on this website — text, product descriptions, photographs, logos, graphics and page design — belongs to Kashmir Online Store or its licensors and is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. Our embroidery designs and artwork remain the property of us and of the artisans who create them.

You may view, download and print pages for your own personal, non-commercial use. You may not copy our product descriptions, photographs, designs or other content onto another website, marketplace listing or catalogue, nor use our name or logo, without our written permission.

11. Reviews and content you submit

If you post a review, photograph, comment or other material, you confirm it is your own, is accurate, and does not infringe anyone else's rights. You grant us a non-exclusive, royalty-free licence to use, reproduce and display that content in connection with our store and its promotion.

We publish reviews as written, whether favourable or critical. We remove only content that is unlawful, abusive, misleading, unrelated to the product, or clearly not from a genuine customer. We are under no obligation to keep submissions confidential, to compensate you for them, or to respond to them.

12. Third-party links and tools

The site links to third-party websites and uses third-party tools, including payment gateways, courier tracking and social media. We do not control those services and are not responsible for their content, accuracy, practices or policies. Any use of optional third-party tools is at your own risk, and you should review their terms before engaging with them.

13. Availability of the site

We aim to keep the website available at all times but do not guarantee uninterrupted access. We may suspend, withdraw, modify or discontinue any part of the site or any product for maintenance or business reasons, without notice.

Information on the site is provided for general purposes. Occasionally there may be typographical errors, inaccuracies or omissions relating to descriptions, pricing, promotions, shipping charges or availability. We may correct these and change or cancel orders where information was inaccurate, even after an order has been submitted.

14. Liability

Subject to that, we are not liable for indirect, incidental or consequential losses arising from your use of the website or the products, and our total liability in respect of any order is limited to the amount you paid for that order.

We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, curfews, internet or transport disruptions, or courier failure.

15. Indemnity

You agree to indemnify and hold harmless Kashmir Online Store, its proprietor, employees and service providers against any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your violation of any law or the rights of a third party.

16. Privacy

How we collect and use your personal data is set out in our Privacy Policy, which forms part of these Terms. We are the Data Fiduciary for that data under India's Digital Personal Data Protection Act, 2023.

17. Changes to these Terms

We may update these Terms from time to time. The version published on this page when you place an order is the version applying to that order. The date at the top shows when they were last revised, and continued use of the site after changes constitutes acceptance of them.

18. Severability and entire agreement

If any provision of these Terms is held invalid or unenforceable, it shall be severed and the remaining provisions continue in full force. These Terms, together with our Privacy, Returns and Delivery policies, constitute the entire agreement between us regarding your use of the Services. Our failure to enforce any right does not waive it.

19. Governing law and disputes

These Terms are governed by the laws of India. Any dispute arising from them or from your use of this website is subject to the exclusive jurisdiction of the courts at Srinagar, Jammu & Kashmir.
